INDIGO INTERNATIONAL 

TERMS OF AGREEMENT & WAIVER


Indigo International is a non-profit organization that has three branches we operate: Pleiadian Institute, OM Apothecary and Indigo Clinics. All payments & fees are processed through Indigo International. We utilize billing and invoicing through two third-party payment processors, Stripe and PayPal. All payments will appear on your banking statements as Indigo International.

By voluntarily utilizing our websites, attending a retreat, Pleiadian Institute courses, Indigo Clinics treatments, meditation programs and holistic health products you agree to our stated policies. By utilizing our websites, scheduling an appointment or enrolling in a membership, retreat or course, you agree to fully comply with our policies, rules and regulations, and any practitioner's instructions regarding holistic health care at home. Indigo International has no responsibility or liability for injury resulting from holistic practices done at home.

SECTION 1: HONOR, RESPECT AND ZERO TOLERANCE 

Our virtual treatment rooms and classrooms are sacred spaces, and it is a privilege to enter them. In our sacred spaces we honor and respect the hearts and minds of all who enter, we ask you to do the same. 

What is honor? To live with honor is to keep agreements and fulfill obligations that you have with other people. We honor you by fulfilling our role in the healing work we do. We ask that you honor our space and process by following this agreement while you are with us.

What is respect? Respect is a feeling of deep admiration for someone or something elicited by their abilities, qualities, or achievements. To respect your heart and mind is to use words that honor you as a being of light. We use language to support you and lift you up. We ask that you also respect our process and our practitioners.

If there is an agreement that is not kept or an obligation not met, we practice honor and respect and work towards a solution.

We practice zero tolerance of any form of bullying or threatening. We practice zero tolerance for shaming, or any behavior that manipulates or exploits any of our practitioners. We practice zero tolerance for any language that puts our practitioners down, intentionally or unintentionally. We ask you to bring your highest self to all treatments and all treatment check-ins.

In our virtual healing spaces, we seek to restore faith in the goodness of humanity. To do this we have high standards for the behavior of our clients.  If a practitioner at any time feels like the conversation or behavior of a client crosses boundaries that are not aligned with our standards of respect and honor for each other,  we reserve the right to immediately end the treatment and to cancel all future treatments.

SECTION 2 - PERMISSION

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the course you are registering for without express written permission by us.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

The material within our websites is always changing. There may be times when you find content that is not accurate, complete or current. We do our best to deliver all content following the schedule we create and update monthly. We reserve the right to modify the contents of this site at any time. We encourage you to communicate with us about any inaccuracies, incompleteness or timeliness. We have a support team that answers questions daily via text message. If you find a problem you are encouraged to report it immediately so that it can be resolved as soon as possible.


SECTION 4 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete and accurate information for all memberships, retreats and courses you register for. If you have signed up for a payment plan, you agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.


SECTION 5 - OPTIONAL TOOLS 

We may provide you with access to third-party tools over which we neither monitor nor have any control. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. You will always be informed about the purpose of all optional tools.


SECTION 6 - COMMENTS & FEEDBACK 

If you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We will always inform you first if we do publish any materials you have sent into us, and/or ask for your permission to share. We do our best to respond to all comments and feedback, however, we are and shall be under no obligation 

(1) to maintain any comments in confidence; 

(2) to pay compensation for any comments; or 

(3) to respond to any comments. 


You can always email indigofamily@indigointernational.org with the words URGENT if you have an outstanding request, comment or concern that has not been addressed and it has been more than 72 hours.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of any part of our online school or any related website.

You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

SECTION 7 - PERSONAL INFORMATION

Your submission of personal information through our websites is governed by our Privacy Policy. If you have any personal information you do not want us to share, please email us to let us know at indigofamily@indigointernational.org

SECTION 8 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information that contains typographical errors, inaccuracies or omissions that may relate to descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information if any information is inaccurate at any time without prior notice.


SECTION 9 - PROHIBITED USES

You are prohibited from using the site or its content:

(a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.



SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You expressly agree that your use of, or inability to use, the membership, course or retreat you are registering for is at your sole risk.

The membership, course or retreat you are registering for and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Indigo International, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.


SECTION 11 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Indigo International and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of this Registration Agreement or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.


SECTION 12 - SEVERABILITY

In the event that any provision of this Student Agreement is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from this Registration Agreement, such determination shall not affect the validity and enforceability of any other remaining provisions.


SECTION 13 - STUDENT WITHDRAWAL

PLEIADIAN INSTITUTE WITHDRAWAL POLICY

Students who enroll in single courses can withdraw at any time, no refunds are provided after 8 weeks. Students enrolled in programs who withdraw are eligible for tuition payment refunds during the first eight weeks following registration, according to the following schedule:

Third Week 60%

Fourth Week 40%

After Fourth Week 20%

After Eighth Week 0%

SECTION 14 - 100% SATISFACTION/REFUND POLICY

You can request a refund in the first 7 days after purchase or attendance in our memberships, courses and retreats. We do not process refunds for completed treatments or gift certificates.

For courses, tuition refunds are only processed within the first 8 weeks after enrollment. After 8 weeks, students are responsible to pay 100% of tuition and fees after withdrawal. If there is a crisis or extenuating circumstance, students can apply for a Tuition Refund Appeal. All requests for a tuition refund must be made in writing first to bursar@pleiadianinstitute.org.

If a dispute is filed with a credit card company or PayPal as a way of procuring a refund without following our policy, a $40 fee will be assessed per dispute.

Students with an outstanding tuition and fees balance will be charged monthly according to the payment plan in place until the balance is completed. All students are responsible to pay the full balance of tuition and any fees after 30 days of enrollment in Pleiadian Institute’s courses.

SECTION 15 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. This Agreement and any policies posted by Pleiadian Institute constitutes understanding between you and us, superseding any prior or

contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Registration Agreement).


SECTION 16 - GOVERNING LAW

This Agreement and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California.


SECTION 17 - CHANGES TO Agreement

We reserve the right, at our sole discretion, to update, change or replace any part of this Agreement.

SECTION 20: CONFIDENTIALITY, LIABILITY & EMERGENCY TREATMENT

Risk, Complications & Results: You understand that although holistic treatments are generally safe, there might be certain side-effects or risks. Our staff will always inform you of such side-effects or risks, but you understand that Indigo Clinic's staff can not be expected to anticipate and explain all possible risks and complications of treatment. Our staff exercises judgment in the interest of your healing during the course of your treatment based on the facts that we are aware of. However, results are not guaranteed.  

Physician Evaluation: Many of our treatments include breathwork. Although technically breathwork is not physical activity, our practices can be physical in nature. A physician evaluation is recommended before starting any physical activity program and it is your responsibility to ensure that your health status allows for safe participation in physical activities such as breathwork. 

Records Confidentiality: All records, including your intake form are kept confidential and will not be released without your written consent. 

Liability: You fully release, waive discharges and agree not to sue Indigo International, its Board, employees or volunteers from any and all losses, causes of action, claims, damages or liability that you, your spouse, child(ren), guests or legally authorized representative may have that are in any way connected to your involvement in our treatments, programs or events. 

Emergency Treatment: You agree to receive emergency medical treatment which may be deemed advisable in the event of injury, accident or illness while under care of Indigo International or while participating in our programs.
